As multiple fans claimed ownership of the baseball, Dustin Robinson, Esq. of LumaLex Law, Jonathan Claussen, Esq. of J Claussen Law, P.A.  and Robert Josefsberg, Esq. of Podhurst Orseck, who are jointly representing the baseball’s rightful owner, Christian Zacek, have reached an agreement with all the other parties involved in litigation that provides clarity to the future buyer that the 50-50 baseball can be sold free and clear of any legal claims against the future buyer.

On Sept. 19, during the Los Angeles Dodgers vs. Miami Marlins Game at loanDepot Park, Dodgers designated hitter Shohei Ohtani hit his 50th home run and stole his 50th base of the season, becoming the first MLB player to reach both milestones in the same season.  Ohtani’s game also marked the first time in MLB history that a player hit three home runs and stole two bases in a single game.  The 50-50 homerun baseball was consigned to collectibles marketplace Goldin Auction house, and an auction for Ohtani’s 50-50 record breaking homerun baseball is underway and set to conclude on October 22.

Robinson, Claussen and Josefsberg released the following statement in response to the agreement that allows the unprecedented auction and sale of the famed 50-50 Shohei Ohtani homerun baseball:

“We are thrilled to announce that all three baseball fans in the Shohei Ohtani 50/50 baseball litigation matters have agreed that the auction and sale of one of the most extraordinary pieces of sports memorabilia in history will proceed as scheduled without any opposition to the sale from each of the fans. This agreement provides certainty to potential buyers that the historic 50/50 baseball will be sold free and clear of any legal claims to the baseball against the future buyer. We believe that this agreement reflects all parties’ recognition of this monumental achievement and will allow the full value of this historic 50/50 baseball to be fully recognized at the auction.”
